Videoconference, 28 October 2025 — The ECAC Legal Task Force gathered online to discuss the outcomes of the Legal Commission at the 42nd ICAO Assembly (Montreal, 23 September – 3 October 2025) and recent ECAC developments in the legal field.
Members acknowledged the departure of Susanna Metsälampi (Finland) from her position as vice-chair of the ICAO Legal Committee. They expressed their deep appreciation for her long-standing and valuable contribution to ICAO’s legal work, and to European engagement in this domain.
The meeting covered follow-up to Assembly discussions, including work on the review of Article 15 of the Chicago Convention and the ongoing examination of the Convention on the Marking of Plastic Explosives for the Purpose of Detection (MEX Convention).
Participants also discussed the status of the Protocols amending Articles 50(a) and 56 of the Chicago Convention, which will expand ICAO Council seats from 36 to 40 once sufficient ratifications are reached. These changes could lead to an extraordinary ICAO Assembly in 2026.
The task force exchanged information on multiple Article 84 cases (disputes between States regarding interpretation or application of the Chicago Convention) currently before the ICAO Council. They noted the growing complexity and workload these cases represent for both the Council and the ICAO Legal Bureau.
The participants also assessed progress on the 2025 work programme and considered initial planning for 2026.
